1. Description of Service and Acceptance of Terms of Use

Moviecastic.com is a content subscription company owned by SDM Network LLC with content that includes audio music, podcast audio, videos, audio sound (for example music and other sounds), graphics, photos, text (such as comments and scripts), branding (including trade names, trademarks, service marks, or logos), interactive features, software, metrics, and other materials whether provided by content license holders, MOVIECASTIC.COM or a third-party (collectively, "Content”).

Content is the responsibility of the person or entity that provides it to MOVIECASTIC.COM. MOVIECASTIC.COM is under no obligation to host or serve Content. If you or or entity see any Content you believe does not comply with this Agreement, including by violating any licensing agreement, you can report it to us directly at contactus@Moviecastic.com.

The MOVIECASTIC.COM website works best with:

1. Subscription Services

This Subscription Services Agreement (the “Agreement”) constitutes a legal, binding agreement between MOVIECASTIC LLC. (“MOVIECASTIC.COM”) and the client identified in the order form (“Users”) for certain archiving or other Services and states the terms upon which MOVIECASTIC.COM provides such Services to Users. The “Effective Date” of the Agreement shall be the date upon which Users first executes the order form for Services (“Subscription Page”). By executing the Subscription Page, Users agrees to the terms of this Agreement; provided that, to the extent of any conflicting term, the Order Form shall supersede this Agreement solely with respect to the conflicting term.

The subscription services will be provided by MOVIECASTIC.COM. Subscriptions are recurring and all users can cancel their subscription at anytime on their dashboard page but will not be refunded any subscription fees prior to cancelling the subscription plan(s).

Third Party Payment Gateway – Financial Information

All payments are processed using a third party payment gateway selected by MOVIECASTIC.COM's financial staff. All third party payment gateway companies are 100% safe and all financial information is secure.

1. Disclosure Children's Privacy

Children's privacy is important to MOVIECASTIC.COM. This disclosure describes how we handle personal information we collect from children under the age of 13 ("child" or "children").

MOVIECASTIC.COM offer some content intended for children, and in some cases we may know a child is using our services (for example, when using a child profile). In these situations, children may share and we may collect personal information that requires verifiable parental consent under the Children's Online Privacy Protection Act (collectively, "Child Personal Information"). Child Personal Information could include, for example, name, birthdate, contact information (including phone numbers and e-mail addresses), voice, photos, videos, location, and certain activity and device information and identifiers (such as cookies, device serial numbers, and IP addresses).

1. Data transfer, storage & processing globally

License to Users Data. “Users Data” means the data of User which is either (a) transmitted to MOVIECASTIC.COM by or on behalf of Users, for archiving purposes, in connection with the provision of the Services; or collected or received via the Services at the direction of Users. Users hereby grants MOVIECASTIC.COM the limited, non-exclusive right to access, copy, transmit, download, display, and reproduce Users Data as necessary to provide, support and improve the Services, or as otherwise authorized hereunder. Users represents and warrants that Users has all necessary rights in and to the Users Data to grant the foregoing license to MOVIECASTIC.COM.

1. Verified Content Owner/Producers

All Verified Content Owner must have a paid MOVIECASTIC.COM subscription to participate in the Verified Content Owner and/or PRO Member Program. When you sign up to become a Verified Content Owner and/or PRO Member on Moviecastic.com you can upload content (audio music, beats, podcast audio, event tickets, and physical products) and get paid a royalty rate on a per sale basis. Verified Content Owner will have a dashboard where Verified Content Owner and/or PRO Member can do the following:

• Verified Content Owner and/or PRO Members can upload audio music, beats, podcast audio, event tickets, and physical products (content).
• Verified Content Owner and/or PRO Members can check their content views.
• Verified Content Owner and/or PRO Members can send a Revenue Request to Admin to collect total Amount.
• Verified Content Owner and/or PRO Members can add their Bank Details or Paypal account to Request Revenue daily, weekly or whenever the Verified Content Owner and/or PRO Member request.

Our system has a unique tracking system for determining fake views. If a Verified Content Owner and/or PRO Member is generating fake views his or her account is red flagged. Our policy states that if a Verified Content Owner and/or PRO Member is generated fake views to boost revenue views, his or her account will be terminated permanently. Verified Content Owner and/or PRO Member content will also be removed from the MOVIECASTIC.COM platform.

Verified Content Owner and/or PRO Member Ownership Policy

Verified Content Owner and/or PRO Member shall have liability insurance coverage sufficient to hold the MOVIECASTIC.com harmless from any accident claim that may result from the action of the broadcaster’s employees or agents, malfunction of equipment, collapse of platform, or any other structure or device which is the property or responsibility of the MOVIECASTIC.com or its agent.

Verified Content Owner and/or PRO Member agree and swear that the content uploaded to MOVIECASTIC.com is 100% owned by the Verified Content Owner and/or PRO Member or have 100% ownership of the rights to all content submitted to MOVIECASTIC.com for publishing.

Verified Content Owner and/or PRO Member Royalty Rate

Verified Content Owner and/or PRO Members will earn a royalty rate of eighty percent (80%) of the net revenue sales for all audio music/productions owned by the Verified Content Owner and/or PRO Member and released on the MOVIECASTIC.COM Platform which is included but not limited to; Mobile apps, Websites and other digital online incorporated, or outlets set forth by MOVIECASTIC.COM LLC minus payment processing fees. All earnings will be paid on a per request basis by the Verified Content Owner and/or PRO Member from the Verified Content Owner and/or PRO Member's dashboard.
